Terms of Service

1. About this service

Kenina Studio (“we”, “us”, “our”) operates an AI-powered custom portrait and art studio at https://kenina.studio (the “Service”). The Service lets you upload your own portrait photographs, select an art style (e.g. watercolor, classical oil painting, royal portrait, anime, pop art), and receive a personalized, high-resolution AI-rendered artwork for personal use, printing, and sharing.

Independent product notice. Kenina Studio is an independent product and interface built on top of third-party AI models (including, but not limited to, image generation models such as Black Forest Labs' FLUX). We are not affiliated with, endorsed by, or sponsored by any model provider. Any reference to a model name describes an integration only, not our brand.

2. Eligibility

You must be at least 18 years old to use the Service, or the age of majority in your country of residence, whichever is higher. By using the Service you represent that you meet this requirement. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts, credits and subscriptions

  • Accounts. You may need to create an account to use paid features. You are responsible for keeping your login credentials secure and for all activity under your account.
  • Credits. The Service uses a credit system. Generation of an image consumes the number of credits shown at the time of your request. Credits have no cash value and are non-transferable.
  • Subscriptions. If you purchase a subscription, credits are added to your account according to your plan (monthly or yearly). You may cancel at any time directly from your account dashboard; cancellation stops future billing at the end of the current billing period and does not refund the current period except as required by law.
  • Payment. Payments are processed securely by our payment provider, Creem. We do not store your full card details. Refunds are handled in accordance with our Refund Policy below and Creem's applicable policies.

4. Your content

  • Photos you upload. You retain all rights to the photographs and other content you upload (“Your Content”). By uploading, you grant us a limited, non-exclusive, worldwide license to use, store, process and transmit Your Content solely to provide the Service to you (including image generation, upscaling, moderation screening, and customer support).
  • Generated images. Subject to your compliance with these Terms, we grant you a non-exclusive, perpetual, worldwide, royalty-free license to use, download, print and share the images generated for you (“Generated Images”) for personal and commercial purposes. This license does not transfer any rights in the underlying AI models or our platform.
  • Warranties. You represent and warrant that you own or have all necessary rights to Your Content, and that you have the consent of any identifiable person (or their legal guardian) whose likeness appears in Your Content.

5. Prohibited uses

You must not use the Service to generate or attempt to generate content that:

  • is sexually explicit, pornographic, or sexually suggestive;
  • constitutes face-swapping, deepfakes, or any manipulation of a person's face or likeness without that person's consent;
  • uses the likeness of another person without their consent (including celebrities and minors);
  • is unlawful, defamatory, hateful, harassing, violent, or threatening;
  • depicts graphic or gratuitous violence, gore, or self-harm;
  • promotes discrimination, bigotry, or hatred against any group;
  • infringes the intellectual property rights of any third party, including copyrights and trademarks;
  • circumvents, disables, or interferes with the Service's content moderation or safety controls;
  • involves minors in any inappropriate or sexualized context (strictly prohibited).

Any attempt to bypass content moderation, or to use the Service in violation of this section, may result in immediate termination of your account and forfeiture of unused credits.

6. Acceptable Use Policy

Use of the Service is also governed by our Acceptable Use Policy, which forms part of these Terms.

7. AI-generated content disclaimer

Generated Images are produced by AI models and may contain imperfections, artifacts, or unintended results. We do not warrant that any Generated Image will match your expectations, be error-free, or be suitable for any particular purpose. You are solely responsible for how you use Generated Images, including any printing, publication, or commercial use.

8. Refund policy

  • Failed generations. If a generation fails after credits have been charged, we automatically refund the charged credits to your account. You can verify this in your transaction history.
  • Subscription refunds. Except as required by applicable law, subscription fees are non-refundable once a billing period has begun.
  • Credit purchases. One-time credit purchases are non-refundable, except where required by law or where we fail to deliver the Service.

9. Intellectual property

  • The Service, including our website, brand, logos, software, and interface, is owned by us or our licensors and is protected by intellectual property laws.
  • You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service, except as expressly permitted by these Terms.

10. Disclaimers

THE SERVICE AND ALL GENERATED IMAGES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

12. Suspension and termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or the Acceptable Use Policy, or if we reasonably believe such action is necessary to protect the Service, other users, or third parties. Upon termination for breach, you lose access to unused credits without compensation, except as required by law.

13. Changes to the Service or these Terms

We may update, modify, or discontinue the Service, or change these Terms, at any time. We will post the updated Terms with a new effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved in the courts located in Los Angeles County, California, USA, and you consent to the exclusive jurisdiction of such courts.
